These Terms of Service (“Terms”) govern your use of https://velenciafragrance.com (the “Site”) and any purchase you make from Velencia Fragrance (“Velencia Fragrance”, “we”, “us”, “our”). Please read them carefully. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract to purchase from the Site. By placing an order you confirm that you meet these requirements and that all information you provide is accurate and complete.
2. Changes to These Terms
We may revise these Terms at any time. The revised version takes effect when posted on this page, and the “Last updated” date will change. The Terms in force at the time you place an order govern that order. Continuing to use the Site after changes are posted means you accept the revised Terms.
3. Your Account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without your authorization. We may suspend or close any account that we reasonably believe has been used fraudulently or in breach of these Terms.
4. Products and Descriptions
We take care to describe our fragrances accurately. Even so:
- Product images are for illustration. Colours vary between screens, and the liquid’s shade may differ slightly from a photograph.
- Note breakdowns describe a composition, not a guaranteed experience. Skin chemistry, temperature, humidity, and application affect how a fragrance opens, develops, and lasts.
- We use natural materials alongside synthetics. Natural absolutes and essential oils vary between harvests, so minor differences in colour or opening between batches are normal.
- Formulations, packaging, and bottle design may be updated over time. The item you receive may differ in minor respects from the listing.
- We do not warrant that product descriptions or other content on the Site are error-free or complete. Where an error affects a material aspect of your order, we will contact you before shipping.
5. Pricing and Pricing Errors
All prices are shown in United States dollars and exclude sales tax unless stated otherwise. Prices are subject to change without notice, but the price shown at the moment you complete checkout is the price applied to your order.
Despite our best efforts, a small number of listings may be published with an incorrect price or incorrect specification because of a data import error, a currency error, or a typographical mistake. We reserve the right to refuse or cancel any order placed at an incorrect price, whether or not the order has been confirmed and payment taken. If we cancel an order for this reason, we will notify you and issue a full refund to your original payment method. We may also, at our discretion, offer you the item at the corrected price and give you the choice to proceed or cancel.
Placing an order at a price that is obviously mistaken does not create a binding contract at that price.
6. Orders and Acceptance
Your order is an offer to buy. The automatic confirmation email you receive after checkout acknowledges that we have received your order — it does not constitute acceptance. A contract is formed only when we dispatch the item and send you a shipping confirmation.
We may refuse or cancel an order, in whole or in part, where:
- the item is out of stock or has been discontinued;
- the listed price or description was incorrect;
- your payment cannot be authorized or fails a fraud check;
- the billing and shipping details cannot be verified;
- we cannot deliver to the address supplied;
- we reasonably suspect the order is for unauthorised resale, or is fraudulent or otherwise unlawful.
We may also limit or refuse quantities purchased per person, per household, or per order.
7. Payment
Payment is taken at checkout. We accept the payment methods displayed on our checkout page. Payments are processed by third-party payment providers, and by paying you agree to the applicable provider’s terms. You confirm that you are authorized to use the payment method you provide.
Sales tax is calculated at checkout where we are required to collect it.
8. Shipping, Title, and Risk
Delivery is governed by our Shipping Policy. Delivery estimates are estimates and not guaranteed dates. Because alcohol-based fragrance is shipped under limited-quantity rules, orders travel by ground and air or express services are not available. Title and risk of loss pass to you upon delivery by the carrier. Where an item arrives damaged, our Return & Refund Policy applies and you should follow the inspection and reporting steps set out there.
9. Returns
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Because fragrance is a personal-care product, change-of-mind returns are accepted only where the item is unopened and sealed.
10. Product Safety and Intended Use
Fragrance is a cosmetic product for external use, and alcohol-based perfume is flammable. By purchasing you acknowledge and agree that:
- our products are for external use on skin and clothing only, and must never be swallowed, inhaled deliberately, or applied to the eyes, lips, or broken or irritated skin;
- you will read the label and any warnings on the packaging before first use;
- you will patch test a new fragrance on a small area of skin, such as the inner forearm, and discontinue use immediately if redness, itching, burning, or swelling develops;
- perfume can cause photosensitivity in some people, so you will take care with sun exposure after applying;
- if you are pregnant, breastfeeding, have a skin condition, or have a known sensitivity to fragrance ingredients, you will consult a healthcare professional before use;
- alcohol-based perfume is flammable and must be kept away from open flames, lit cigarettes, heaters, and other ignition sources, and must not be sprayed near a flame;
- products must be stored below 30°C, away from direct sunlight, heat, and humidity, and must not be left in a parked vehicle;
- products must be kept out of the reach of children and away from pets, and are not intended for use on children;
- you will not decant, dilute, rebottle, mix, or otherwise alter our products, and we accept no responsibility for any product that has been altered after delivery;
- you are responsible for disposing of empty or damaged bottles in accordance with local rules for aerosols and flammable liquids.
Content on the Site is provided for general information and is not medical or dermatological advice. Full ingredient information appears on the packaging of each product; if you have an allergy, check it before use and contact us if anything is unclear.
11. Warranties and Disclaimer
We stand behind the quality of what we make. Every fragrance is blended, filled, and sealed to our own specification, and a faulty or damaged item is covered by our Return & Refund Policy.
We do not, however, warrant that any fragrance will smell a particular way on you, last a particular number of hours, be detected by others at any particular distance, or produce any specific personal or cosmetic result. These outcomes depend on individual skin chemistry and conditions we cannot control.
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, Velencia Fragrance and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of data, or loss of use, arising out of or in connection with your use of the Site or any product purchased from it, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to any order will not exceed the amount you actually paid for the product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.
13. Indemnification
You agree to indemnify and hold harmless Velencia Fragrance and its officers, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law, or your misuse of any product purchased from us.
14. Prohibited Uses
You may not use the Site to break any law, to infringe anyone’s rights, to submit false or misleading information, to upload malicious code, to scrape or harvest data by automated means, to interfere with the security of the Site, or to place fraudulent orders. You may not resell, decant, rebottle, or relabel our products for commercial sale without our written authorization. We may terminate your access for any breach of this section.
15. Reviews and Submissions
If you post a review, comment, question, or any other content on the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, adapt, publish, and display that content in connection with our business. You confirm that the content is your own, is accurate, and does not infringe anyone’s rights. We may edit or remove any submission at our discretion, but we are not obliged to monitor submissions.
16. Intellectual Property
Our fragrance names, the Velencia Fragrance name and logo, our bottle and packaging design, our product photography, and the layout, text, graphics, and compilation of content on the Site are owned by Velencia Fragrance or its licensors and are protected by United States and international intellectual property law. You may not copy, reproduce, republish, or distribute any part of the Site for commercial purposes without our written permission.
Any third-party name that appears on the Site is used descriptively only. See our Legal Notice for further detail.
17. Third-Party Links
The Site may link to third-party websites. We do not control those sites, do not endorse their content, and are not responsible for any loss arising from your use of them.
18. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, war, civil unrest, labour disputes, carrier failures, supplier failures, ingredient shortages, utility outages, and government action.
19. Governing Law and Venue
These Terms and any dispute arising out of them or out of your purchase are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree that the state and federal courts located in Fort Bend County, Texas have exclusive jurisdiction over any such dispute, and you consent to the personal jurisdiction of those courts.
20. Informal Resolution First
Before filing any claim, you agree to contact us at support@velenciafragrance.com and give us 30 days to resolve the matter directly. Most issues are settled quickly this way.
21. General
- Severability — if any provision of these Terms is held unenforceable, the remaining provisions continue in full force.
- No waiver — our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment — you may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement — these Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and Legal Notice, are the entire agreement between you and Velencia Fragrance regarding the Site and supersede any prior understanding.
